folgender Sachverhalt:
Flug Shanghai - Kopenhagen - Hamburg. Gebucht bei SAS, durchführende Airline auch SAS. Es wurden keine Einzelflüge gebucht.
Der Flug von Kopenhagen nach Hamburg wurde aufgrund von technischen Problemen storniert.
Ich habe 600 € eingefordert da die Entfernung zwischen Shanghai und Hamburg mehr als 3.500 km beträgt. SAS hat einen Bus organisiert welcher in Hamburg mit einer Verspätung von 6 Stunden eingetroffen ist.
Nun die Antwort von SAS:

I am sorry that your trip did not go according to plan, and I do
understand your disappointment and frustration. I will, without getting
to much into flight terms or getting too legal, try to explain why we
cannot meet your request for compensation of 600EUR
in this case.
SAS determines the distance based on our interpretation of Article 7 p. 1 in EU Regulation 261/2004 which states that "In determining the distance, the basis shall be the last destination at which the denial of boarding or cancellation
will delay the passenger's arrival after the scheduled time."
The starting point for measuring the distance, is in other word the
airport from where the delayed/cancelled flight departs. That means that
if a passenger has a booking including 3 flight segments and the delay
occurs in the second flight segement, the measuring
will start at the airport from which the second flight segment departs.
For more information regarding this I refer to judgment from the German
Landshut Regional Court the 16th of December 2015 in case 13 S 2291/15,
where the point of reference when measuring the distance is the airport
from which the delayed flight departs.
Since flight SK998 on the 2nd of July 2017 from Shanghai to Copenhagen
operated on schedule, the distance should be measured from the last
destination, at which the cancellation/delay will delay the passenger's
arrival after scheduled time, which in this case
was Copenhagen where flight SK647 was cancelled. Since the distance
between the affected leg and the final leg is less than 1500 km, we are
able to compensate 250EUR. The money shall reach your account within 7
working days.

Aus meiner Sicht handelt es sich bei 13 S 2291/15 um einen völlig anderen Sachverhalt. Hier wurde versucht die Distanz zum Umsteigeflughafen mit einzuberechnen.
Vermutung: SAS versucht nur etwas Geld zu sparen. Wie seht Ihr den Sachverhalt?
